These terms govern your use of Clearwell. By downloading or using Clearwell, you agree to these terms. If you don't agree, don't use the app.
1. License Grant
When you purchase Clearwell, you receive a personal, non-exclusive, non-transferable license to use the app and its content on your iOS or Android device. You may not:
- Sell, rent, lease, transfer, or sublicense the app or your access to it
- Copy, reverse-engineer, modify, or create derivative works based on the app
- Remove copyright, trademark, or other proprietary notices
- Use the app for any unlawful or prohibited purpose
2. Purchase & Payment
Clearwell's full question bank is sold as a non-renewing, one-time in-app purchase through Apple's App Store or Google Play.
- The purchase price is $12.99 USD (price may vary by region and is subject to applicable taxes)
- Payment is processed by Apple or Google, not by 8086 LLC
- Your purchase is non-refundable except where required by law or the store's policies
- If you purchase using a family plan or shared subscription, your use of the app may be subject to additional restrictions
To request a refund, contact Apple through your App Store account settings, or Google through Google Play.
3. No Warranty; Disclaimer
Clearwell is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8086 LLC does not guarantee that:
- The app will be error-free or uninterrupted
- Clearwell will help you pass your exam (exam success depends on your effort and knowledge)
- The content will remain accurate forever without updates
- Questions will cover every topic on the actual state exam
Clearwell is a study tool, not a guarantee of exam passage.
4. Limitation of Liability
To the maximum extent permitted by law, 8086 LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Clearwell, including:
- Failure to pass an exam
- Loss of job opportunities or professional advancement
- Loss of data or device damage
- Any other damages of any kind
Our total liability shall not exceed the amount you paid for the app (typically $12.99).
5. Content and Intellectual Property
Our content: All questions, explanations, and content in Clearwell are original works created by 8086 LLC and are protected by copyright. You may not copy, reproduce, distribute, or extract the question bank for any purpose other than personal study.
Source citations: Every question cites its public source (EPA guidance, state regulatory documents, etc.). You may use those public sources freely according to their own terms. Our selection and arrangement of questions, however, is our own intellectual property.
Your content: You retain ownership of any feedback you send us. By sending feedback about Clearwell, you grant us the right to use that feedback to improve the app.
6. Prohibited Uses
You agree not to use Clearwell for:
- Scraping, extracting, or exporting the question bank
- Reverse-engineering or decompiling the app
- Using the app in violation of any law or regulation
- Sharing your access with others (your license is personal to you)
- Attempting to bypass any payment, security, or access controls
7. Accuracy and Updates
We work to keep Clearwell's questions accurate and current. However:
- Exam content and regulations can change without notice
- We provide updates when available, but updates are not guaranteed
- It's your responsibility to verify critical information against official sources before your exam
If you discover an error, please report it to support@8086.llc.
8. Termination
Your license to use Clearwell continues for as long as you maintain your purchase. However, we reserve the right to:
- Discontinue Clearwell at any time (with notice where feasible)
- Remove the app from the App Store or Google Play (your purchased copy remains yours)
9. Changes to Terms
We may update these terms at any time. If we make material changes, we'll update this page and its date. Your continued use of Clearwell means you accept the updated terms.
10. Privacy
Your use of Clearwell is subject to our Privacy Policy. Please read it to understand our data practices.
11. Governing Law
These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law provisions. Any legal action must be brought in the state or federal courts located in Washington.
